Research On Copyright Recognition Of Live Sports Events

Internet today,mobile media,such as information technology level unceasing enhancement,live sports industry rise and rapid development,however,behind its rise,sports broadcast images of infringement cases emerge in endlessly,but in many other similar infringement facts behind the case,around the judicial practice on the value judgment is somewhat different,the so-called "Same case,different sentence".In addition,although the current Copyright Law 2020 has made some adjustments compared with the previous copyright law,it is still difficult to provide a clear legal basis for the issues related to live images of sports events,and the rights holders are still facing legal difficulties in safeguarding their rights.In view of this,it is extremely necessary to study the copyright issues of live images of sports events.This article will be divided into five parts to study the copyright issue of the live broadcast images of sports events.First,on the basis of clarifying the relevant concepts of the live broadcast images of sports events,starting from the current situation of the cases of disputes over live broadcast images of sports events in recent years in judicial practice,this paper summarizes the problems they face,and combining with the relevant legislation and judicial arrangements in foreign countries,based on the discussion and theoretical analysis of this aspect in our country,this paper analyzes the qualitative problem of the live broadcast pictures of sports events,that is to say,the originality of the live broadcast pictures of sports events and whether they can constitute audio-visual works.And put forward corresponding suggestions,in order to be able to balance the rights of the rights of the rights and social interests on the basis of the future,for the live broadcast of sports events on the infringement of the dispute cases to provide a reasonable basis for judicial decisions,to protect the rights of the legitimate rights of the rights.
