Research On Pure Economic Loss Compensation In Environmental Tort

The compensation for pure economic loss in environmental tort is one of the important issues in the field of environmental responsibility,related to the degree of legal protection of various interests,and of which duly handle can help balance the relationship between the victim,the enterprise and the society.How to make the compensation for pure economic loss in environmental tort is an urgent problem in China today.However,the current legal framework of our county is difficult to solve the problem of such losses,and in the event of an environmental tort,the relief for victim will face with legal challenges.However,the environmental tort has far exceeded the scope of the traditional tort law theory on account of its particularity.If we still adjust the legal relationship of environmental tort by the means of traditional legal theory,we will not only be able to solve the problem of compensation for pure economic losses in environmental tort,but also difficult to protect the needs of social development and the legitimate rights and interests of the victims.Therefore,the research on the compensation for pure economic loss in environmental tort has important theoretical significance and practical significance.This paper mainly studies through comparative study and normative analysis to compare and analyze the relevant legislation and practice of compensation for pure economic loss in environmental tort between foreign representative countries and our country,and expounds the basic theory,compensation principle,scope and limitation of the compensation for pure economic loss in environmental tort.This paper studies the compensation for pure economic losses in environmental tort from both theoretical and empirical aspects,and puts forward some suggestions for perfecting the compensation for pure economic losses in environmental tort in view of the shortcomings of legislation and judicial practice in our country.In addition to the introduction and conclusion,this paper is divided into three chapters.The first chapter mainly elaborates the basic theory of the compensation for pure economic loss in environmental tort by analyzing the concept,characteristics and institutional value of pure economic loss in environmental tort.The second chapter mainly combs the relevant legislation and judicial practice of compensation for pure economic loss in environmental tort,and then puts forward the shortcomings existing in our country at present.The three chapter is based on the deficiency of the legislation and the judicial practice of our country,and drawing lessons from the legislation and judicial practice of other countries to put forward proposals to improve the system of the compensation for pure economic loss in the environmental tort of our country in the aspects of the Legislative Model,the determination of the scope of the compensation and the application of the compensation standard.
