Study On The Law Prevention Mechanism Of Campus Violence Crime In China

In recent years,the increasingly violent campus crimes have aroused widespread concern of the public and serious concern about the juvenile delinquency.Campus violence crime is the result of many factors.Therefore,prevention and control of campus violence need to be handled from the perspectives of family,school,justice and society.Moreover,in recent years,China has successively revised and passed a number of juvenile related laws and regulations,including the Criminal Law,the Law on the Protection of Minors,the Law on the Prevention of Juvenile Crime and the Law on Community Correction.The revision is a response to academic and public controversies,such as whether the age of criminal responsibility needs to be adjusted and the feasibility of abolishing the long-criticized institutionalization system.Through the analysis and summary of some practical cases,this paper finds that there are some characteristics of campus violence in China,such as light violence and heavy insult,obvious trend of gang crime,bidirectional violence and fixed place of violence.Combined with the existing laws and regulations and relevant disposal rules,there are still some practical problems in the prevention and treatment of juvenile campus violence crimes in China,such as the light investigation of guardians’ judicial responsibility,unclear school educational punishment rules,insufficient specialized education system,blank classification system of film and television works,and rigid age of criminal responsibility.In view of this,China can take measures to reduce the age of criminal responsibility for individual application,forced guardians to accept parental education,improve the system of special schools,implement the community correction system,improve campus management measures,strengthen the violence information control efforts to improve the prevention and control of juvenile campus violence crime.
