Study On The Cause Of Formation And Preventive Countermeasures Of School Violence Crime In Primary And Secondary Schools In China

In China,violent crimes in primary and secondary schools occur frequently,and violent crimes in schools have become one of the important reasons for disturbing the safety of primary and secondary schools.Statistics show that from January 2018 to October 2019,procuratorial organs across the country prosecuted 6,962 cases of campus violence,an 18.39 percent increase over the same period last year.In 2018 the Supreme People's Court issued the campus violence crime judicial big data project report,from 2015 to 2017,the campus violence crimes in the Midwest are at higher risk,still all over the country at the grass-roots level in bringing the court of first instance of campus violence crimes are mainly concentrated in henan,guizhou,shandong,etc in the Midwest,developed cities such as Beijing,Shanghai,in such cases is much lower than other regions.In the school violence crime cases,88.74% of the victims of the school violence crime cases have a considerable degree of casualties,and even more than 30% of the victims have serious injuries.In the face of the increasingly obvious phenomenon of the young age of the subject of crime and the increasing trend of serious violent crimes,it is urgent and necessary to make an in-depth analysis of the reasons for the frequent occurrence of violent crimes in China's primary and secondary schools and to seek corresponding countermeasures and preventive measures.This paper is divided into four parts:The first part is the introduction.This paper briefly describes the research background,purpose and research status of violent crime in primary and secondary schools at home and abroad.The second part is phenomenon analysis.Based on the definition of violent crime in primary and secondary schools,the paper analyzes the overall characteristics of violent crime in primary and secondary schools.With K city prosecutors review of 186 cases of primary and middle school campus violence crimes as the breakthrough point,from the criminal subject,criminal object,the perspective of the overall characteristics of cases,by using big data analysis and case in form,on the whole situation of our country middle and primary school campus violence crimes,multi-angle analysis and sum up out of the campus violence crime exists in the majority with crimes happens,gang crime,crime is clearly younger age,higher percentage of left-behind children suffer various characteristics.The third part is the reason analysis.According to the specific characteristics of the phenomenon of school violence in primary and secondary schools,the causes of school violence crime cases are analyzed in a multidimensional way.Through sorting out the cases of campus violent crime in primary and secondary schools,it can be seen that the cases of campus violent crime have their special features in the issuing subject,case type and case nature.From the point of individual factors,crime main body personality development is not sound and legal consciousness is the source of primary and middle school campus violence happens,from environmental factors lack of family education,the bad social ethos,lack of school education under the rule of law,to a certain extent,make no effective control school violence crime,is the external cause of primary and middle school campus violence crime,the campus security law related prevention and control system is not sound is likely to cause primary and middle school campus violence law of factors.The fourth part is countermeasures.To prevent and dissolve the occurrence of violent crime in primary and secondary schools is the author's original intention of writing this paper.This part firstly provides institutional guidance for the construction of safe campus from the perspective of improving the legislation related to campus violent crime and strengthening the cooperation between judicial organs and primary and secondary schools.Secondly,starting from the main site of campus violent crime,it is suggested to clarify the security responsibility of the campus,strengthen the basic legal education on campus,and establish a perfect campus security prevention and control system.Thirdly,from the perspective of strengthening family protection,we should focus on improving parents' awareness and ability of guardianship and strengthening family supervision,so as to establish a family defense line to prevent school violence crimes.Finally,from the perspective of improving social governance,strengthening social and cultural management and constructing humanistic care network,this paper aims to consolidate the responsibility of the society for the safety of primary and secondary schools.Through the construction of a comprehensive prevention and control mechanism among individuals,families,schools and various social subjects,the occurrence of campus violent crime cases can be prevented comprehensively.
