The status and power of the supervisory committee are constantly being strengthened.How to regulate the discretionary behavior of supervisory agencies in the process of supervision,investigation,and disposal has gradually become the focus.Judging from the investigations of violations of laws and regulations by supervisory cadres in recent years,in addition to individual persons who know the law and violate the law and directly trample on the authority of laws and regulations,more people use their discretionary power to "kick the edge" for personal gain.Therefore,how supervisory agencies at all levels perform their supervisory functions well in the current increasingly complex environment and regulate the implementation of supervisory discretionary behavior has a major impact on the complete victory of the anti-corruption struggle.From the perspective of power division,the current state supervision has achieved full coverage of the legislative,administrative,and judicial fields.In view of the wide scope of supervision and the large number of research objects,this article only selects the most extensive business scope,The field of public administration with the most complicated matters and the most people involved,exploring and researching the discretionary behavior in public administration supervision.This article takes the discretionary behavior in public administration supervision in our country as the research object,comprehensively uses public choice theory,power restriction theory,rent-seeking theory and other theoretical foundations on the basis of existing research,and uses questionnaire surveys to monitor freedom in the process of public administration supervision.The areas where the discretionary behavior is implemented,the impact,the problems and the causes are investigated and analyzed.Through investigation,it is found that the discretionary behavior in the process of public administrative supervision is mainly implemented in the three areas of supervision and inspection,investigation and verification,and disposal decision by the supervisory agency.Due to the irregular discretionary behavior of some supervisors in the public administrative supervision,the supervision and inspection are arbitrary and arbitrary.The frequent occurrence of cases of personal misconduct and different punishments for similar cases has led to the reduction of the credibility of the supervisory organs,the frequent problems of power rent-seeking,the deterioration of the quality of anti-corruption cases,and the promotion of the privileges of some supervisors.The reasons are mainly reflected in the four aspects of laws and regulations,personnel quality,work transparency,and case review.Based on the analysis of the reasons,this article explores four major aspects to propose detailed interpretations of laws and regulations,strict authorization standard control,perfect procedures and regulations,improve personnel access and elimination mechanisms,strengthen professional ethics,improve education and training systems,and improve work Transparency,improvement of internal supervision mechanism,improvement of external supervision system,improvement of case trial mechanism,improvement of case review procedures,establishment of case responsibility system and other countermeasures and suggestions. |
