Research On Victim Rescue Of Criminal Cases From The Perspective Of Governance Theory

After long-term development and practice in China,there are more and more criminal cases caused by various conflicts,which leads to an increasing number of victims.After entering the new era,the means and methods of crime are changing all the time,and the harm of the new technology-type crime(telecommunication and network fraud)is particularly prominent and serious,which brings serious harm to the criminal victims.Aiming at the current problems,made a relatively complete legal system in our country,but some aspects of the legal system has certain hysteresis and omissions,lead to all kinds of criminal cases,the victim issues also emerge in endlessly,such as the criminal victims and their families may suffer from the administrative judicial organ of the secondary damage,resulting in itself caused the contradiction will be transferred to judicial organs,In turn,it is transferred to the national government,which leads to the frequent cases of extreme retaliation against society and blatant challenge to government authority,for which the whole society has paid a heavy price.Dive deeper into the reasons,the greatest impetus to hate society comes from the bitter criminal cases,because ordinary conflicts and disputes do not sacrifice their own interests to hurt the innocent.In the face of the type of case,our country’s criminal processing system is limited to fight crime law damages,in respect of other rights relief is the administrative judicial organ,basically no institutional safeguard,the victim can only obey the arrangement of judicial organs,no other rights protection,which provides a hotbed,judicial corruption and unfair to the victim rights and interests is damaged,The changing crime situation calls for a change in the way our society is managed.In view of the above problems,this thesis first introduced the core concept of the criminal victim and the basic knowledge of governance theory,and then analyzed the problems existing in the rescue work of the victims of the current criminal cases,mainly including the rescue situation and existing problems of the victims of the current criminal cases.Finally,the thesis analyzes and studies the problem of public sector criminal victim assistance,and puts forward corresponding countermeasures and suggestions,including:(1)comprehensive legislation to protect criminal victims at the national level;(2)Accelerate the transformation and upgrading of state organs,and pay close attention to the efforts of judicial organs to recover the losses of criminal victims;(3)Establish the information release platform of criminal victims and improve the investigation system of criminal victims;(4)Give full play to the value of criminal victims relief organizations.
