| The object of this paper is the legal issues of the protection of patients’ privacy.The purpose of this paper is to provide some feasible suggestions for improving the legal system of patients’ privacy protection in China.The content of this paper mainly includes the meaning,characteristics,forms and subjects of infringement of patients’ privacy,the practices of some western countries and regions in privacy and patients’ privacy protection law and the enlightenment to China,and the suggestions to the legal system of patients’ privacy protection in China.The research methods used in this paper mainly include literature research and comparative research.European and American countries first put forward the concept of patients’ privacy in the world,and their protection of patients’ privacy is also in the forefront of the world.In the era of big data,some people with ulterior motives use big data technology to easily steal patients’ privacy information from all aspects of people’s lives;Patients’ privacy information is often leaked and used unconsciously.The invasion of patients’ right to privacy causes great trouble to patients’ normal life,ranging from property loss to health and even life safety.When the right of privacy is independent from the right of reputation,China has formulated many legal norms on the protection of patients’ privacy.However,in the civil law of the protection of patients’ privacy,the scope of patients’ privacy has not been defined.By analyzing and comparing the practices of the United States,Germany and the European Union,combined with China’s current national conditions and the loopholes in the protection of patients’ privacy,the author suggests that,on the basis of referring to the practices of relevant countries and regions in the protection of patients’ privacy and patients’ privacy,we should conform to the trend of scientific and technological development,and establish a unified and complete system of laws and regulations for the protection of patients’ privacy,And from strengthening the protection of network technology,improving the self-discipline of the industry,strengthening the professional ethics of medical staff,and improving the awareness of patients’ rights protection to promote the protection of patients’ privacy. |
