The Study Of The Coordination Of The Conflicts Between The Right To Privacy Of The Infectious Patients And The Right To Know Of The Other Citizens

In modern society, the right to privacy as a basic right is being paid more and more attention. Perfecting and enforcing the legislation and justice protection for the right to privacy is very important, especially for the infectious patients. At the same time, with the development of the society, the right to know has also become a very important right. People demand to know everything, including national policies and social affairs. What's more, they also wish to know the others' personal information which relates to their interests. For those who contact the infectious patients closely, they demand to know the patients' disease information. Thus, the conflicts will be caused between the infectious patients and the people contacting them closely. In the essay, I try to analyze and discuss the conflicts between the right to privacy of the infectious patients and the right to know of the other citizens so as to find some ways to coordinate the conflicts between them.The essay consists of three parts: the foreword, main body and epilogue. In the foreword, I introduce the current study of the right to privacy and the right to know, as well as the problems they exist and the significance for protection. The main body is composed of four chapters. In the first chapter, I analyze the basic theory of the two rights, what's more, there are also some special characteristics about the infectious patients. In the second chapter, I analyze the conflicts between the infectious patients and the people contacting them closely .Firstly, I describe some kinds of conflicts between the infectious patients and the people contacting them closely. Secondly, I analyze the reasons why there are some conflicts existing. Thirdly, I illuminate the importance to coordinate the conflicts between them. The third and the forth chapter are the main bodies of the essay .In the third chapter, I introduce the current situation in the legislation and justice field, at the same time, pointing out the problems which should be improved. In the forth chapter I address the ways to balance the conflicts between the two rights from three angles, namely, consciousness, law and society. In the epilogue, which is the last part of the essay, I summarize my own viewpoint in several sentences: It's reasonable for the two rights existing. To coordinate the conflicts between them, we should perfect and enforce the legislation and education, what's more, we should pay more attention to moral education.
