Results Ult Promotion: Causal Theory Of Causal Crime

Help-offender is a kind of accomplice form that helps the principal offender to carry out the infringement and may cause the result of the legal benefit infringement.Therefore,this paper discusses the causality of helping offenders,so as to clarify the attribution of helping offenders.This article has four chapters to carry on the detailed introduction.In the first chapter,we find out the help behavior in several cases,and then carefully analyze the criminal law of these help behaviors,so as to sum up the question we want to discuss,what is the relationship between the help behavior and the behavior of the principal offender or the result of the infringement of legal interest,whether there must be a causal relationship,if the answer is yes,whether there is a causal relationship between the help behavior and the principal offender’s behavior,or whether there is a causal relationship between the help behavior and the principal offender’s result,or whether the help behavior has a causal relationship with the principal offender’s result,which is the key question to be discussed in this paper.The second chapter is the key chapter of this paper,mainly narrates the academic circles to help commit the causality each kind of opinion,roughly divides into does not need to have the causality not to say and needs to have the causality necessity to say,The causality is not to be divided into abstract dangerous criminals and specific dangerous prisoners,the causality is necessary to say and divided into positive behavior,the revised positive results and several categories,respectively gives examples and evaluation of these theories,and points out its advantages and disadvantages.The third chapter mainly talks about the promotion of causality,which is also the core point of this article.It can clearly reflect the process and role of helping behavior in criminal behavior.Then I specified the reasons for promoting causality and the meaning of the word "promote" in law and the degree of promoting causality,thus answering the question of helping to commit causality.The fourth chapter is on the basis of the above theory through physical and psychological causality two methods to help the scope of causality,physical causality is tangible,can be taken out to prove the behavior,items,etc.,is easier,and psychological causality is difficult to judge,can only through some external behavior to prove its inner thought,but also difficult and not as good as the physical causality judgment accurate.
