Study On The Limit Of Privacy Right In The Property Declaration System Of Public Officials In China

Today under the big trend of anti-corruption in our country,public officials property declaration system as an important part in establishing of the system of preventing corruption,is bound to intensify the public and scope in order to achieve a more thorough anti-corruption requirements,in the perspective of prevention before regulating the behavior of public servants legitimate exercise of power,to create a clean and transparent government.How to meet the needs of citizens’ right to know and right of supervision under the requirement of preventing corruption in China,that is,to reasonably restrict the right of privacy in the property declaration of public officials,so as to protect public interests from damage is the focus of our research.In the property declaration system,there is a conflict between the restriction of privacy right and the protection of citizens’ right to know.On the basis of the public interest priority,a balance can be reached through the clear definition of the right subject,which is also the key to improve the system.The conflict between citizen’s right to know and the subject,item and scope of disclosure in the property declaration system leads to the problems existing in the definition of privacy restriction in the property declaration system.In combination with our practice in the development of the problems of the system,perfecting property declaration system embodies the necessity of the privacy permissions,in draw lessons from the successful experience of the outside area system development and China’s practice,summarizes the basis of lessons,puts forward the definition about privacy restrictions in perfecting the property declaration system solutions,While realizing the purpose of property declaration system,the right to privacy of public officials should be guaranteed by procedure and relieved afterwards.To make public officials more willing to accept the implementation of the property declaration system,accelerate the promotion of institutional legislation,improve the anti-corruption preparation system in advance.
