| Based on the analysis of the background,necessity and process of reform in China’s "integration of arrests and prosecution " system and the current situation in People’s Procuratorate of Beijing Haidian District,this article tries to analyze the impact of this reform to the prosecutors’ working status and efficiency of handling cases;sort the concrete problems this system countered in practice,and put forward with some corresponding opinions and suggestions by questionnaires and on-the-spot investigation.This research report consists of five chapters.Chapter I is an overview of the investigation,which explains the purpose,objects,research ideas and methods.Chapter II is the background,mainly introducing the concept and historical development of the "integration of arrests and prosecution " system,the theoretical analysis and criticism from the academia on this reform’s value.Chapter III introduces the implement of the questionnaires and on-the-spot investigation.Chapter IV analyzes the concrete problems this system countered in practice.After this round of reform,the procuratorate’s judicial efficiency has been improved,the ability to guide investigations has been strengthened,the level of specialization has been enhanced and internal differences has been reduced,but there are still some problems like the imbalance of allocation in case-handling,the lack of diversities in evaluation criteria,the vague standards of arrests and prosecution and the weakness of the external supervision;Chapter V is based on the analysis of Chapter IV and combined with practice to further improve this reform Four suggestions were put forward,including improving the allocation of inspection resources,strengthening the auxiliary prosecution staff,strengthening business training,clearly demonstrating the standard of certification for prosecution and review of arrests,improving evaluation standards,multievaluating the quality of inspection work,strengthening internal supervision,and activating external supervision system. |
