On The Copyright Protection Of Sports Live Programs

With the rapid development of China’s economy and China’s technological level is constantly improving,the cultural life of the people is constantly increasing.China pays more attention to the development of sports career and sports industry and China is making efforts to develop its sports industry in a more comprehensive way.More perfect information network infrastructure and the rapid emergence of smart products such as mobile phones and computers,it is easier for people to enjoy more sporting events.As a result,people have more and more access to live sports events and the number of people watching live sports events is also increasing.Live sports events have formed a huge commercial market with huge commercial value,and the related broadcast platforms and broadcasting platforms have gained rich profits.Some live broadcast platforms and individuals broadcast live sports events without the consent of the owners,cases of infringing live sports events are on the rise.The courts at different levels have different opinions on the nature of the program,the different nature of the program will lead to different judgment results,academia also has different criteria to judge the nature of live sports events.Whether live sports events can be protected by copyright law as works is the core dispute and difficulty of judgment in infringement cases.The author will judge the nature of live sports events and sort out the protection status of live sports events programs in foreign countries,try to protect the legitimate interests of the producer,make sports events more stable and healthy development,this paper is elaborated through the following five parts :The first part,"Overview of Sports Live Events ",this paper analyzes and discusses the sports events,the live programs of sports events and the signals of the live programs of sports events,the similarities and differences between the related concepts are summed up,to better understand the characteristics of live sports events.Academia has different views on whether live sporting events are works or video products.Some scholars believe that live sports events should belong to works if they meet the requirements of originality standards,while others believe that live sports events should belong to video products because it did not meet the required standard of originality.The second part,"Controversy on the Legal Attribute of Live Sport s Events",by sorting out relevant typical cases,this paper expounds what kind of standards courts adopt to judge the attributes of live sports events in judicial practice,analyze the facts of the case,the reason of the judgment and the result of the judgment,and analyze the reasons for the different legal attributes.The third part,"Originality Analysis of Live Sports Events",sports live TV,through the comparative analysis of the national standard of the original two law systems,find the original reference value standard of our country,and of a work’s copyright law in our country,an analysis of the boundaries of originality in Chinese works,comprehensive analysis of the causes of live sports essence identity,as well as the difference between the live sports and other live sports.The fourth part," Current situation and experience of protection of live sports events in foreign countries",investigation and analysis of the United States,the United Kingdom and other common law countries how to protect live sports events,Suggestions on how to improve the live sports programs in China are put forward.Research and analysis of Germany,Japan and other civil law countries to protect the legal system of sports live programs,Summarized the civil law countries to protect the legal system of live sports events program beneficial experience.The fifth part,"suggestions on improving the copyright protection of sports live programs",through the Suggestions for the perfection of the above understanding,put forward different professional skills of sports live TV production requirements,need to distinguish between independent personnel or professional organization for sports live different standards,the original to determine sports live TV ideas,can be more objective and fair to reflect the original work.Sports live TV conforming to the original standards will be protected by copyright law as "audio-visual works".In view of copyright protection cases of sports live TV guidance,network broadcast platforms should strengthen cooperation with multiple departments to protect each other’s interests of producers,and the development of sports industry will be more stable and faster.
