Research On The Legal System Of Urban Employees’ Endowment Insurance

With the increasingly severe form of population aging,the accelerated pace of new urbanization,the continuous and in-depth advancement of comprehensive deepening reforms,and the large number of urban employees,the demand for endowment insurance and related services in China will continue to rise in the future.In this regard,it is necessary to plan ahead and carry out a more comprehensive,in-depth and continuous reform of endowment insurance.Since the beginning of reform and opening up,although China’s urban employee endowment insurance has established the basic endowment insurance which covers the largest number of urban workers,it has initially established and multi-level endowment insurance model,and has achieved world-renowned achievements,but the rule of law is not sound and the multi-level model still has problems in balance and incoordination,it has loopholes in fund supervision,underdeveloped dispute resolution mechanisms and other issues still restrict the sustainable development of pension insurance.The contradiction between the people’s growing need for a better life and unbalanced and inadequate development is in the field of pension insurance.The performance is more prominent.Therefore,it is to sum up the experience and lessons of the reform of endowment insurance system and draw on international experience.It requires to be practical and realistic.This dissertation aims to contribute to the development of endowment insurance with socialism with Chinese characteristics.This dissertation is divided into five chapters.The first chapter is the introduction.It introduces the background and significance of the topic,it summarizes and reviews the research status at home and abroad,and clarifies the research ideas and methods of this article.The second chapter is about the basic concepts and theories,it analyses the connotation of endowment insurance for urban workers.It discusses the relevant theories of endowment insurance law,focuses on the concept of right of social security and the concept of fairness and justice,and draws on the theoretical achievements in other fields,which involves the third road theory and the theory of active aging.The third Chapter reviews the historical evolution of the legal system of the pension insurance for urban employees and analyzes the current legal system.It affirms the achievements of reform and development,and points out that the main problems include the imperfect legal system and the imbalance of the multi-level pension insurance system and their respective shortcomings,insufficient supervision of endowment insurance funds.The forth Chapter is comparative analysis of foreign pension systems.Three examples are selected from developed countries,including the United States,Sweden and France,while two examples are developing countries,including Chile and Thailand.It aims to review and summarize the endowments insurance reforms of five countries,which is helpful to condense institutional experience.The fifth chapter explores the institutional measures to improve the endowment insurance,including the improvement of the legal system,the improvement of the basic endowment insurance,enterprise annuity,and individual commercial pension insurance in the multi-level endowment insurance system,the establishment of a safe and effective fund supervision model.It is believed that under the track of the rule of law,the endowment insurance for urban workers in China will be able to make steady progress and play a more effective role in ensuring the life of the elderly.
