A Study Of The Standardization Of Local Legislative Language In The Context Of Precise Legislation

In order to guarantee the quality of local legislation and promote the comprehensive rule of law,it is necessary to study the standardization of local legislative language,so as to improve the degree of standardization and make it meet the requirements of precise legislation.At present,our country has put forward higher requirements for local legislative language for two reasons: On the one hand,after the new amendment of the legislative law in 2015,the authority of local legislation has been expanded;On the other hand,the new concept of precise legislation puts forward higher requirements on the standardization of local legislative language.However,in reality,compared with the national legislative language,the nonstandard problems of local legislative language is more prominent,and the academic research on local legislative language is still in a relatively inadequacy state.The background of the introduction part briefly introduces the reason and significance of the research on the topic of "research on the standardization of local legislative language under the background of precise legislation",and briefly outlines the main framework of this paper.Literature review mainly introduces the research overview of legislative language and local legislative language in and outside the region.This paper studies in the framework of legal theory and general linguistics theory.Literature research method is the specific research method used in this paper.The significance of this paper includes two aspects.On the theoretical level,the research on the standardization of local legislative language is an interdisciplinary study of law and linguistics.Therefore,this study not only enriches the content of legal linguistics,but also develops the principles of legislation and the legal theory.In practice,this paper focuses on the nonstandard reasons and normative strategies of local legislative language,which helps to make the local legislative language meet the standardization requirements of precise legislation,and effectively guarantee the quality of local legislation,which has practical significance for the effective implementation of the law and promoting the comprehensive rule of law.The main body is divided into four chapters.The first two chapters are the introduction of local legislative language and precise legislation.The third chapter lists the nonstandard phenomenon of local legislative language in detail,explores the nonstandard reasons and summarizes the corresponding negative effects.In the last chapter,guided by the concept of precise legislation,and combined with the local actual situation,four strategies are put forward to improve the standardization of local legislative language.The first chapter takes the local legislative language as the research object,discusses the connotation of the local legislative language,the specific characteristics and essence of the local legislative language,and the connotation and significance of the standardization of the local legislative language.First of all,only by defining the connotation of "local legislative language" can it be better studied.Secondly,because the local legislative language is different from the legislative language in personality,that is,specific characteristics,regional characteristics and experimental characteristics,it is necessary to carry out special research on it.Thirdly,authority is the essential attribute of local legislative language.Improving the standardization of local legislative language is helpful to maintain its authority.Finally,the last section of the first chapter discusses the connotation and significance of local legislative language standardization.The second chapter is the precise follow of local legislative language,mainly introduces the practical needs,basic principles and requirements of local legislative language.Summing up the practice of local legislation in the past 40 years,our country’s legislation has gradually changed from "extensive legislation" to "precise legislation".Therefore,in order to achieve precise legislation,the local legislative language should meet the requirements of "accurate affirmation,rigorous specification,concise,simple and solemn".The third chapter takes the current local normative legal documents as the research object,analyzes the nonstandard phenomenon of local legislative language,summarizes the nonstandard reasons,and points out the negative effects.There are many nonstandard problems of language in local normative legal documents,which are mainly reflected in five aspects: vocabulary,grammar,semantics,style and punctuation.The main nonstandard reasons are the lack of enough attention of the role of legislative language by local legislature,the repetitive legislation of the relevant contents of the upper law and the same law,the lack of research on legislative language technology,and the lack of language review mechanism.In the last chapter,guided by the concept of precise legislation,and combined with the local actual situation,four strategies are put forward to improve the standardization of local legislative language.First of all,the establishment of local legislative language corpus.Secondly,local laws and regulations should be issued to standardize the local legislative language.Thirdly,authoritative local legislative language requirements should be established.Finally,it is necessary to build the pre procedure of local legislation,namely the language review mechanism.Therefore,this paper has spent a lot of time to explore and discuss the connotation,theoretical basis and construction path of local legislative language review mechanism.At present,the domestic academic research on local legislative language is still in a relatively insufficiency state.Moreover,for the research on the subject of local legislative language,the academic only makes a static enumeration study on the legal terms,rhetorical style,punctuation and other issues in the local normative legal documents,and does not make an in-depth and systematic discussion on the local legislative language at the theoretical level,It will not help to solve the problems that may arise in the practical application of local legislative language.Therefore,from the perspective of legal linguistics,guided by the concept of precise legislation,this paper takes the current local normative legal documents as the research object,analyzes the nonstandard reasons,and discusses the standardization strategies of local legislative language,hoping to help improve the standardization degree of local legislative language and the quality of local legislation.
