Research On The Victims Of The Crime Of Fraud On Live Webcast

In recent years,there have been frequent cases of victims of crimes of online live broadcast fraud in our country,such as Liu Guobiao,Yang Jie’s public welfare fraud,and Yang Mourui,a typical case of cybercrime issued by the Supreme People’s Procuratorate.The crime of webcast fraud is a new type of online crime.It uses webcast as a scam intermediary to conduct a series of fraudulent acts in the live broadcast room,which seriously damages the victim’s property interests,affects the victim’s sense of security,and disturbs the stable webcast environment.Most academic researches on this issue only focus on criminals and criminal behaviors,and seldom focus on victims,but victims play an indispensable role in webcast fraud crimes.In order to reduce the occurrence of the crime of scams in the live webcast,this article conducts research from the aspect of the victims of the scam crimes in the webcast.The author screened 90 cases of criminal cases of webcast fraud(Appendix 1)and 12 cases of criminal cases of webcast fraud closed by the Public Security Bureau of a certain city from October 2019 to October 2020(Appendix 2)Analyze a total of102 cases,summarize the definition and characteristics of the victims of this type of crime,the interaction between the victim and the offender,and the factors of the victim,with a view to proposing feasible and effective prevention measures for the victim.This article is divided into five parts.The first part is the definition of the crime victim of webcast fraud.Through the definition,characteristics and types of webcast,the webcast is defined as the scam intermediary and the webcast room is the location of the crime.The boundary of criminal behavior,understand the victim from the characteristics of webcast and webcast fraud and conduct qualitative research.The second part is the analysis of the characteristics of the victims of webcast fraud crimes.Using 102 cases as a sample to conduct statistical analysis,it is concluded that there are as many as seven ways of victimization.The victims are mostly young,and the male victimization rate is relatively high.Victim culture The degree is too high.Many people were killed in one case,and the number of users was more than that of the anchor.The typical characteristics of the victim being victimized in the immersive experience.The third part describes the interaction between the victim and the offender of the crime of webcast fraud based on the relevant theoretical knowledge of victim science.Analyze from two levels of interaction process and interaction mode.The process is divided into four stages,namely,initial acquaintance,building trust,introducing scams and post-victim response.The interaction mode is divided into available victim mode and voluntary victim mode.The fourth part is about the analysis of the victimized factors of the crime of webcast fraud.According to the specific analysis of 102 case data,combined with the theory of daily activities,life style exposure theory and other victim science theories,the analysis is carried out from the two levels of the victim’s victimization and the victimization situation,and it is found that the victim’s victimization is mainly based on blind faith and strong material desires,Panic-easy and fearful psychology,excessive "curiosity",and often exposed to the public network status,the bad lifestyle of constantly disclosing their living conditions in the webcast room,and the lack of ability to recognize webcast fraud.Harmful situations include the supervision of live broadcast platforms,poor management,and the drawbacks of the freeze payment mechanism,as well as the overlapping functions of government supervision.The victim is exposed to dangerous situations and the chance of being victimized increases.The fifth part is the discussion on the prevention of the crime of live webcast fraud.This part is based on the analysis of the previous part of the victimization factors and proposes targeted prevention measures for victimization.Analyze from two aspects: reducing the victim’s victimization and eliminating the harmful situation.First,we will prevent victims by changing their lifestyles,changing bad psychology,and enhancing the ability to recognize fraud in live webcasts.Secondly,from the regulation of webcast platform login methods,the creation of anti-fraud education modules and innovative supervision models,the improvement of victims’ funds transfer methods,and the strengthening of the government’s unified and coordinated supervision to reduce the chance of being victimized.
