Research On Legal Issues Of Network Mutual Supervision

As a new Internet financial product,internet mutual aid has the characteristics of insurance and charity.It has the characteristics of low entry threshold,high mutual aid amount and wide coverage.It is expected to become another important part of the medical security system in the field of serious illness,so as to reduce the burden of serious illness for ordinary residents.At this stage,there is no special laws and regulations to supervise the network mutual assistance in our country,and the application of the current civil laws and regulations is not comprehensive,and even the qualitative of the network mutual assistance has not been unified in the legal theory and practice.Therefore,it leads to the wanton development and disputes of network mutual assistance without specific regulatory subject and specific regulatory norms.Moreover,when the court tries such cases,there are great differences in the legal relationship and applicable legal norms.Therefore,this paper starts with the definition of network mutual assistance,introduces the different definitions of different scholars and network mutual assistance platforms,points out that it is in the stage of lack of defining norms,and determines the concept of network mutual assistance on which this paper is based,and then discusses and analyzes the legal nature of network mutual assistance and the legal relationship between subjects based on the current legal norms and Judicial Adjudication Cases in China,Introduce the network mutual aid.At the same time,it lists the problems existing in the supervision of network mutual assistance in China,in order to introduce the current situation of the supervision of network mutual assistance in China.In order to solve the problem of network mutual supervision in our country,we carry out the investigation of foreign network mutual supervision,and try to learn from the successful experience of foreign supervision.Finally,this paper attempts to put forward the corresponding design scheme for the supervision of network mutual assistance in China,such as: determining the legal nature of network mutual assistance,clarifying its regulatory subject,and issuing specific regulatory norms and model contract texts for network mutual assistance.If the network mutual assistance can be effectively supervised,it is expected to help the reform of China’s medical security system,and provide assistance for the comprehensive establishment of a medical security system with basic medical insurance as the main body,medical assistance as the backing,supplementary medical insurance,commercial health insurance,charitable donation and medical mutual assistance in 2030.
