| True and accurate testimony of witnesses plays an important role in conviction and sentencing.However,a large number of judicial practice and psychological studies show that compared with physical evidence,documentary evidence and other physical evidence,witness testimony often changes in quantity or even quality.In judicial practice,wrongs of justice often occur due to false witness testimony.How to accurately identify false testimony and maintain judicial justice is the focus of scholars.The examination difficulties caused by witness testimony are universal,which can not be solved without psychological science.Reality Monitoring and Statement Validity Assessment are psychological techniques to examine and judge whether witness statements are true and reliable.In some European countries,the results of the Statement Validity Assessment have been used as evidence in criminal courts,but it is more appropriate to evaluate child witness statements and true statements.However,Reality Monitoring has a more solid theoretical basis and a wider application prospect,and its lie criterion has changed the tendency of relying on "fact criterion " to Statement Validity Assessment.This study through the literature methodology to systematically review and summarize the memory psychology,cognitive psychology,psychology of lying,real monitoring statements and effectiveness evaluation related theory,and the empirical research,based on the real monitoring for the main frame,and merge state the effectiveness evaluation,formulating Credibility Analysis Standard of Witness Testimony.This study selected 60 master studengts in 19 grades from a police academy as subjects,using the single factor experimental design,by analyzing the witness statements,compared to criterion analysis group(using Credibility Analysis Standard of Witness Testimony)and non-criterion analysis group(use common sense and experience)to distinguish the testimony of true and false testimony,Test the validity of Credibility Analysis Standard of Witness Testimony.The conclusions of this study are as follows:(1)There are altogether 15 standards for Credibility Analysis Standard of Witness Testimony: visual information,voice information,descriptions of people’s physical features,descriptions of people’s injuries,descriptions of people’s clothing or weapons,descriptions of one’s feelings or state,descriptions of other person’s feelings or state,respondents’ evaluation of the event,location information,relative position information,descriptions of time,descriptions of the sequence of events,descriptions of extraneous details,descriptions of secondary events,unsubstantiated speculation.The first 14 criterions are the truth criterion and the 15 th criterion is the lie criterion.(2)Credibility Analysis Standard of Witness Testimony is operable.(3)The ability of Credibility Analysis Standard of Witness Testimony to distinguish true statements from false statements is significantly superior to common sense and empirical judgment. |
