Study On The Local Protection Mechanism Of The Veterans’ Rights And Interests In China

Since the 19th National Congress,China’s attention to the protection of veterans’ rights and interests has risen to a new height.The construction and improvement of the protection mechanism of veterans’ rights and interests is not only the recognition of the contribution and sacrifice made by veterans during their service,but also of great significance to the maintenance of national tranquility and social stability.Although the relevant legal system has been gradually completed and the overall work has entered the stage of "the year of implementing regulations and policies",there is still a problem that the local implementation is relatively small and slow.Based on this background,this paper examines the problems of local veterans’ rights and interests protection mechanism in China from the perspective of the recent development of protection work,the standardization of local legislation and the rationality of local administration,in order to find solutions for improving local protection mechanism and further promoting the smooth development of local veterans’ service management in China.This paper firstly researches the theories of veterans’ rights and interests,and clarifies the theoretical scope of "veterans" and the specific content of "rights and interests".Secondly,by collating the recent developments of veterans’ rights and interests and the normative analysis of local legislation,the current situation of local mechanism for guaranteeing veterans’ rights and interests in China is sorted out.The results achieved in veterans’ service management in China are confirmed,and the existing characteristics of local legislation in terms of legislative form,validity level,legislative content and legislative plan are summarized,so as to lay the foundation for problem identification and solution.Then,through the overall analysis,the problems of local rights and interests protection mechanism in terms of "legal system","military-local interface" and "dispute relief" are found,and it is proposed to clean up the duplicate regulations,set up a special agency for the military,and strengthen the departmental structure.We also proposed to clean up the duplicated regulations,set up a special institution for the military,strengthen the cooperation of departments,and introduce the hearing mechanism.Finally,the analysis of the implementation of specific rights and interests,four representative aspects of medical care,employment,welfare and praise are selected as the entry point for individual problems,and some provinces and cities have made exemplary reform activities as additional examples to give corresponding suggestions for solutions.A good law or policy,without the corresponding complete and smooth supporting mechanism and implementation details will not really be implemented and play its proper value,to lay a good foundation of local security for veterans,in order to stabilize the rear upwards and truly benefit the people downwards.
