Research On The Protection Of The Rights Of Veterans In China

Since the establishment of the Department of Veterans Affairs in April 2018,the protection of veterans' rights has gradually entered the public eyes,and its related policies for the benefit of the army have been gradually improved.In particular,the drafting of the Law on the Protection of Veterans has also been new breakthrough.It can be seen that the work of safeguarding the rights of retired military personnel is receiving more and more attention from all parties.As an important part of China's national defense construction,the protection of the rights of retired military personnel not only affects their benefits directly,but also has extremely positive impacts on military personnel.In addition,the implementation of protecting retired military personnel's rights rely heavily on state policies,which may result in their rights of employment and career selection can not be fully guaranteed in practice.To this end,given on the particularity of retired military personnel,the author tries to explore the deficiencies of the current legal system of protecting retired military personnel's rights,and build Chinese law and special care system of retired military personnel by combining the experience of foreign retired military personnel protection.Because the academia's research mainly focus on the aspect of social security and public administration,there are few studies on the rights of retired military personnel from a legal perspective.Besides,the theoretical circles regard the legal system of retired military social welfare as a part of China's social security law,but due to its ambiguity on policy and law,the academic community lacks relevant theoretical research.Therefore,it is challenging for author to explore how to guarantee retired military personnel's rights from the perspective of social arranging law,but the related research needs to be further studied.Despite of the introduction,this paper is divided into four parts:The first part mainly summarizes the concepts and categories which related to retired military personnel and social care.Secondly,it discusses the attribute of therights of retired military personnel from the perspective of jurisprudence,and points out the particularity of the rights of retired military personnel.In addition,this part sketches out the historical development of retired military personnel's social special care legal system,we can tell it had been through the transition from policy to legalization.The second part discusses the status quo of the protecting the retired military personnel's rights and the legislation of social special care in China.Secondly,it summarizes the problems and its causes in protecting the rights of retired military personnel.The third part mainly analyzes the foreign countries how to guarantee retired military personnel's rights,it includes the United States,the United Kingdom,and Russia,based on that,the author concludes relevant extraterritorial experience.The last part is mainly discussing the protection of veterans' rights,carrying out the legislative concept related to the social special care law,and constructing the relevant content of the social special law,the specific rights and rights relief of the veterans.
