A Study On The Protection Of The Legal Rights Of The Ex Serviceman In China

The protection of the rights and interests of ex servicemen's resettlement is not only a major project related to national stability and social development,but also a major test for the military and local work.In order to do this work well,China has gradually established a system of demobilized and resettled servicemen,which is suitable for the planned economic system,in combination with the national conditions and the needs of social development.This not only solves the actual needs of the ex servicemen in terms of resettlement,but also injects vitality into the country's economic development and social production.However,with the rapid development of China's economy and the continuous improvement of the reform of the personnel system of local institutions,there are some problems in the current system of the placement of retired soldiers to adapt to the social development and practical needs in the new era.For example,in the process of specific resettlement,there are some problems such as not being able to be resettled in accordance with the law or the differentiation of resettlement treatment in different places,which not only affects the authority of the law,but also is not conducive to the protection of the legitimate rights and interests of our country's veterans.Therefore,from the perspective of the rule of law,this paper analyzes the problems and causes in the resettlement of veterans,and puts forward suggestions to improve the relevant system,which is of great significance to properly deal with the protection of the rights and interests of the resettlement of veterans in the new era.Based on the review of the existing literature and the author's own experience,this paper studies the issue of the protection of the rights and interests of the placement of the veterans in China,so as to provide a reference for the improvement of the laws and regulations of the placement of the veterans,the improvement of the relevant security system,and the efficient deployment of the placement work in the new era.This paper mainly discusses from the following five aspects: the first part is the introduction,which mainly introduces the research background,research significance,literature review and research methods of this paper;the second part analyzes the current situation of the protection of the rights and interests of the ex servicemen's resettlement,and expounds the concept and legal basis of the rights and interests of the ex servicemen's resettlement,and the current situation of the protection of the rights and interests of the ex servicemen's resettlement;The third part analyzes the existing problems and causes of the protection of the rights and interests of the retired soldiers in our country;the fourth part discusses from the perspectives of overseas experience,legislation,law enforcement and the improvement of relevant systems,and puts forward suggestions to improve the protection of the rights and interests of the retired soldiers in our country;the fifth part summarizes the whole paper.Based on the literature,this paper discusses the protection of the rights and interests of the ex servicemen's resettlement from the theoretical and practical aspects,hoping to realize the legalization of the protection of the rights and interests of the ex servicemen's resettlement in our country,and make the ex servicemen's resettlement change from political tasks to legal responsibilities.
