Research On The Prevention Of Raping Minors

In recent years,the number of cases of raping of minors in China has continued to grow.The situation of raping of minors is serious.It is expected that the number of cases will continue to show multiple trends in the future.The number of new types of crimes,such as cyber-dating rape,will continue to rise.And underage victims remain the key protection group of our legal system.Amendment（Ⅺ）to the Criminal Law of the People’s Republic of China increased criminal penalties for the raping of minors and added the offence of sexual assault by persons with caring responsibilities.However,the path of aggravating circumstances is still to be tested for the purpose of maintaining normal social order and protecting the sexual rights of minors.Moreover,what is special about the crime of raping of a minor is that the injury to the minor is persistent and cannot be remedied.Whatever severe punishment is meted out to the perpetrator after the fact,it is the broad just conscience,not the real victims,that is comforted.Therefore,in addition to focusing on the punishment of raping of minors after the fact,more attention should probably be paid to the effective prevention of raping of minors in advance of the occurrence of illegal acts,because "crime prevention is more sophisticated than punishment." In order to prevent such crimes effectively,prominent triggers should be identified and targeted prevention programmes designed.In view of this,this paper summarizes the current situation of prevention and treatment of raping of minors based on adjudicative document statistics,combs the previous literature with Cite Space software,and constructs a binary Logit model based on Eviews 7.0.It follows that the hypothesis is first put forward,then tested（looking for prominent causes of raping of minors）,and finally put forward countermeasures（designing programs to prevent the cases of raping of minors）.First of all,this paper proves the hypothesis that the absence of family custody is significantly related to the crime of raped by acquaintances and has a large influence coefficient.This finding is consistent with the phenomenon reflected in the refereeing data of raping of minors in China.Although this kind of cases in our country can not be fully reported and counted due to many subjective and objective factors,only some of the crimes are seen in the judgment.However,it can also be generally analyzed that the crime is not sufficiently deterred by punishment,young people are more vulnerable to abuse,the crime of acquaintances is high and the crime is highly concentrated in space.Then,on the basis of the above findings,this paper further explores the relationship between the problem and the solution path to find effective and concrete means of prevention.In view of these problems,preventive countermeasures are put forward.In order to ensure that the sexual rights of minors are not violated,a legal network has been closely organized from the three perspectives,by reducing the victimization of minors,monitoring the criminal environment and improving the legal protection of minors,especially with regard to special family protection.
