With the vigorous development of new economy,new industries and new business forms in recent years,in the field of labor and employment,the employment forms of workers and the employment methods of employers are undergoing profound changes.At the same time,new problems and new phenomena in the field of labor and employment are undergoing profound changes as well.There are endless problems,especially the tension between labor and capital caused by the overtime work of laborers and the overtime employment of some employers.In recent years,the "996" and "007" work systems that have appeared in some industries in our country have aroused discussion and attention in the whole society.It seems that the situation in which workers in capitalist society suffered from overtime labor described by Marx in the 19 th century has suddenly appeared in the In some industries and production and operation organizations in China.This makes more and more people think and ask,what are the similarities and differences between overtime labor under the conditions of a socialist market economy and overtime labor in a capitalist society?Does this kind of overtime work belong to exploitative labor in the context of Marx? How to properly solve the problem of overtime labor under the institutional environment of the socialist market economy? Based on the thinking and answering of the above questions,this research is of great significance for examining the realistic response of Marxist labor theory to the socialist market economy environment,building harmonious labor relations,and effectively safeguarding labor rights and interests of laborers.This paper starts with the problem of overtime labor,and takes Marx’s thought on the working day,the theory of absolute surplus value,and the theory of alienated labor as theoretical foundations.By analyzing the field and main characteristics of overtime labor under the socialist market economy,it reveals the current reality of overtime labor by employers.According to the scenario,the reason for the unresolved overtime labor is the unreasonable wage and working hour system of non-public enterprises,the production and operation purpose of maximizing profits,the imperfect supervision and supervision system,and the concessions of workers under employment pressure.In the end,the countermeasures and suggestions for regulating overtime labor are put forward in response to the above problems,mainly starting from the improvement of legislation and law enforcement,creating a healthy working environment,and improving the ability of laborers,to explore and promote laborers to "get out" of the predicament of overtime labor,and to improve labor economic rights and interests of laborers.The basic path to be effectively guaranteed.The article mainly includes four parts: The first chapter mainly introduces the background of the topic selection,and analyzes the theoretical value and practical significance of the research in this paper in combination with the current social circles’ realistic concern for overtime labor.The current situation is systematically sorted out,the research method of this paper is clarified,and the innovations and deficiencies of this paper are summarized.The second chapter is the definition of overtime labor and its related concepts and the retrospect of Marx’s labor theory,so as to reveal the research object and theoretical basis of this paper.By defining the concepts of overtime labor,excessive labor,forced labor,and decent labor,the research object and scope of this paper are clarified;by sorting out Marx’s theory of working days,absolute surplus value theory,alienated labor theory,etc.The theoretical research provides rich theoretical support.The third chapter is based on the analysis of the general principle of overtime labor,and it is placed in the environment of the socialist market economy system.The existence field and main characterization of the overtime labor problem studied.At the same time,this paper conducts a theoretical perspective on the overtime employment behavior of employers under the socialist market economy,points out the reasons for the existence of overtime labor,and aims to answer the similarities and differences between overtime labor under the socialist market economy and capitalist society,and then It provides ideas and directions for the effective regulation of overtime labor under the conditions of socialist market economy.The fourth chapter is based on the previous analysis and research,and puts forward the countermeasures and suggestions for effectively regulating overtime labor under the condition of socialist market economy.In view of the overtime labor and overtime employment behavior of laborers in some industries and employers,this paper proposes specific regulatory countermeasures from the government,employers,and laborers,in order to help laborers "get out" of the predicament of overtime labor,and make workers Labor and economic rights and interests are effectively protected.
