Along with the market-oriented reform of public utilities,the government monopoly mode of operating public utilities has been broken.The government grants franchise rights within a certain range by entering into franchise agreements with enterprises.Franchise has become an important mode of public utility operations in China.Under the franchise model,in order to protect the public's demand for the universal and continuous provision of public goods and services,government regulatory responsibilities have become particularly important.Temporary takeover is the embodiment of the government responsibility as a regulator,and its existence is justified.However,there are some drawbacks in temporary takeover,such as low legislative rank,low legislative technical level,non-uniform local application conditions,lack of provisions on takeover procedures and follow-up treatment,etc.,resulting in the temporary takeover system being abused by individual administrative agencies in practice and the rights and interests of franchise enterprises violated from time to time,which is not conducive to the privatization reform of public utilities.Therefore,the study of the temporary takeover system has great practical significance.By perfecting the legislation of temporary takeover,regulating the takeover behavior of administrative agencies,it can provide a good institutional guarantee for privatization reform.
