Research On The Investigation Power Of My Country's Supervisory Commission

On March 20,2018,with the official promulgation of the supervision law of the People's Republic of China,China's power structure has undergone a major transformation.A new political system was formed,in which a government,a committee and two courts replaced a government and two courts.The supervisory commission is a major creation of China's political system reform.Although it is positioned as a special anti-corruption body,it is not clear about the nature and specific norms of its powers of investigation.How to define the investigative power of the supervisory commission? How to exercise the right of investigation and how to supervise the commission effectively? Is the current theoretical and practical circles are very concerned about the topic.Although the discussion between the theoretical and practical circles is very heated and the relevant research results are abundant,most of the focus is on the nature of the investigation right,the connection of supervision and inspection and other issues,but there is little in-depth research on how to regulate the exercise of the investigation right.Only by deeply studying the contents and procedures of investigation power can the anti-corruption function of the supervisory commission be given full play.Paper first begin from case by case to reveal,supervisory committee in China in the exercise of such investigations,the investigation and approval procedure of measures of lien is not strict,the supervision of the investigation of evidence to prove that standard is not clear,lack of enforcement power supervision committee to exercise effective supervision,problems such as the incomplete legal norms,through the analysis of the superficial problems connecting deep reason is not smooth,the lack of effective supervision and finally embarks from the cause,by perfecting the supervision legal norms,the optimized mechanism,the construction of diversified supervision system,strengthen the rights and interests safeguard supervisory object summarized four aspects,such as concrete ideas to solve the problem.
