Research On Dispute Resolution Mechanism Of PPP Project Contract

Public-Private-Partnership(PPP)model is the economic model that has been vigorously promoted by Chinese government in the past three years.This paper focuses on the legal relation of project contract under this model.After making the theoretical definition of the nature and content of PPP project contract,this paper analyzes the provisions of China's legislation on the dispute resolution mechanism of PPP project contract and the related practice of PPP project contract dispute resolution in China,This paper also points out the problems of legislation and practice of PPP project contract dispute resolution mechanism,and make suggestions to construct a perfect PPP project contract dispute resolution mechanism.The full text is divided into four chapters.Chapter ?-Overview of PPP Project Contracts and its Dispute.This chapter defines and expounds the concept and system of PPP project contract,and analyzes the legal nature of PPP project contract and related disputes.Chapter ?-The Basic Content of PPP Contract Dispute Resolution Mechanism.Starting from the PPP legislation in China and abroad.,this chapter carding the legal provisions related to the dispute resolution of the PPP project contract,and analyzes the legal structure of the main dispute resolution mechanism from the legislation of PPP.Chapter ?-The Dilemma of Dispute Resolution Mechanism of PPP Project Contract in China.This chapter is based on the actual situation of PPP project in our country,and summarizes the dilemma of PPP project contract dispute resolution in legislation and practice.Chapter IV-Suggestions on Perfecting Dispute Resolution Mechanism of PPP Project Contract in China.Based on the conclusion of first three chapters,this chapter insists that perfecting PPP dispute resolution mechanism should pay attention to the guiding principles and concepts,to improve the supporting mechanism and establish the PPP dispute resolution integrated system on the basis of the unified legislation.
