Research On Program Control Of Temptation Investigation In My Country

The procedure control of temptation investigation is a way to standardize the investigation behavior.As the implementation of this kind of investigation measure will bring more serious risk of human rights violations than other investigation measures,we should not only regulate it in legislation,but also strictly control the starting conditions of temptation investigation in combination with the current requirements of comprehensively promoting the rule of law in China.And in the process of implementation of strict supervision,put the power into the cage of the law,to prevent the temptation of investigation is abused.This article combines the experience of foreign countries on the procedure of luring investigation,and based on the investigation practice of our country,puts forward that there are some problems in the procedure of luring investigation in our country,such as unclear starting conditions,lack of supervision procedure and imperfect relief procedure.In order to give full play to the advantages of luring investigation in criminal activities and cure the disadvantages brought by illegal luring investigation,we can improve the program design of luring investigation by clarifying the applicable principles of luring investigation,refining the program content of luring investigation and constructing the supervision mechanism of luring investigation.In order to ensure that investigators can use this special type of investigation measures to fight against crime in accordance with the law,avoid the abuse of power,and reduce the risk of human rights violations in this process.
