Action Practice And Logic Of Village Women's Lawsuit For Divorce

Litigation,as an effective "safety valve" to deal with marital conflicts,plays an extremely important role.However,the existing research has not focused on the selection of the path of divorce by village women and the investigation of the logic of follow-up actions.This paper focuses on the divorce litigation cases in L town of Guanzhong in recent years,and aims to explore the dual cultural background of the village field in the "no litigation" tradition that has long been pursued and the "rural" evaluation system that has only supported women.Why does the female party divorce in the way of litigation,why is it possible to take this way,what is the formation mechanism behind it,and what is the specific action logic that women uphold in the whole action process before and after they enter the judicial field? In essence,the phenomenon that village women resort to litigation for divorce is the self-deconstruction and reconstruction of the traditional cultural elements of "non-litigation" and "rural nature" contained in the village society itself.
