Research On Extradition Of Pirate Criminals

Pirate crime emerged with the development of human navigation.In recent years,with the development of economic globalization and the increasingly close economic exchanges among countries,pirate crime also presents new characteristics such as wide area,fine division of labor and strong professionalism.Extradition,as an important form of international criminal judicial cooperation,plays an important role in the process of combating piracy.However,due to the promulgation of the Convention on the High Seas and the United Nations Convention on the Law of the Sea for a long time,it is difficult to solve the new problems arising from the extradition of criminal pirates.In view of the problems existing in the extradition of pirate criminals,through the study of relevant laws at home and abroad,this paper is discussed in three parts.First of all,the necessity of extradition of pirate criminals is clarified,and the current situation of extradition of pirate criminals at home and abroad is expounded.Secondly,it discusses the practical problems in the extradition process of pirate crime.Finally,according to the existing problems in the pirate criminal related legal concepts,breaking through the traditional principle of extradition,seeking alternative measures for extradition and other aspects of the perfect suggestions.
