Research On Civil Electronic Litigation System

Electronic Civil Procedure is an outcome of electronization,which will adapt to the court-centered internal systems and the party-centered litigation process.Electronic litigation conforms to the new trend of the reform in the digital age,whcih demonstrates the efficiency and rapidness of information technology in the judicial field.Courts,parties and other participants take advantage of information technology to participate in ligitation activities,as well as complete the electronic application of many aspects such as filing,service and trial,which will be beneficial to reduce judicial costs,improve litigation efficiency,safeguard procedural rights,then further expand the depth and breadth of the judiciary.This paper adopts the research methods of value analysis,induction and summary to analyze our current practice of electronic litigation and justice in China,based on which we'll put forward some suggestions,such as,formulating systematic electronic civil legislation,establishing and improving relevant provisions of litigation about online filing,electronic service and remote trial.Aiming to eliminate the defects of the imbalanced development of crouts in various regions and the imperfect guarantee mechanism of electronic litigation,this paper will offer some proposals,such as,optimizing the electronic litigation platform,enhancing information technology and strengthening the training of judicial personnel from the perspective of standardizing the practice of electronic litigation and improving relevant safeguard measure.
