Research On The Determination Of The Copyright Of Artificial Intelligence Creations

The generation of artificial intelligence(hereinafter to be referred as “AI”)is a great creation in the present day,however it brings some social issues.AI technology contributes to the innovation in the way of creation.The new way of creation has a great impact on the order of human society,which brings the challenges to the laws and rules,especially in the field of copyright law.This may lead to subversion of the traditional cognition,and what's worse,different kinds of defects would occur to the current legal system.Regarding the copyright of AI creations,issues concerning copyright infringement have taken place in the real world,however,there is no clear protection to the copyright of AI creations in the field of current laws,which makes it difficult to seek for the assistance when the creations are infringed in practice.The paper analyses the copyright protection of AI creations,and is divided into three parts.The first part determines the concepts,characteristics and types of AI and AI creations.After defining the AI creation principles,AI creations are classified into advanced AI creations and primary AI creations based on different stages of the development of AI technology.Meanwhile,there are two main problems concerning the protection of the copyright of AI creations.The first problem is whether AI creations could be identified as the works,while the other one is the belongings of the copyright of AI creations.The second chapter discusses the first question further and discovers that AI creations could be considered as the works when they meet both requirements in essence and form.There would be understanding of the originality of the works in essence and the duplication and content of AI creations in form.The third chapter states the belongings of the copyright of AI creations.The fund providers,application designers and AI users do not own the copyright.Although the above-mentioned groups are closely related to AI creations,they should not be granted copyright due to the arrangement of the system.
