Research On Legal Remedies For Personal Injury Of Vocational College Students

Internship is a necessary part of practical teaching in vocational colleges.Students keep "zero distance" contact with the professional posts.Due to the lack of work experience and risk prevention abilities,internship injury accidents happen frequently.How to help the injured students effectively,how to keep the enthusiasm of enterprises to participate in the internship,and how to ensure the practical effect of the internship are the problems in the development of vocational education.This paper is divided into five parts:In Introduction,the content,background,significance,methods and research status of this research are introduced.In Chapter ?,the nature,characteristics and significance of internship are expounded,and the characteristics of vocational colleges students' personal injuries and the causes of frequent accidents during internship are analyzed.In Chapter ?,based on the real cases of personal injury rights protection during internship,the practical difficulties and causes of the personal injury problems are analyzed from the legislative protection and judicial relief.In Chapter ?,the legal identities of the interns are analyzed from the subject qualification conditions and objective subordination conditions.The legal relations among the three subjects,colleges,enterprises and students,during the internship are defined.And the legal relief principles of personal injury protection with interest balance,responsibility sharing and mutual aid are also defined.In Chapter ?,the countermeasures to perfect the legal relief of personal injuries during intership is put forward.The legal relief of personal injuries of vocational college students during internship should be strengthened systematically.In terms of prevention beforehand,first,special laws and regulations should be formulated for internship.The compulsory insurance systems such as internship liability insurance and internship injury social insurance should be established through legislation,and compulsory internship agreement system should be implemented through legislation to smooth the contract legal relief.The judicial interpretations should be provided to ensure that tort liability law relief is unimpeded.Second,the internship management system should be improved to form a four-in-one internship injury prevention system for the government,colleges,enterprises and students.In terms of post-disaster relief,the channels of judicial relief for students' personal injuries should be broadened and the quality and efficiency of legal aid with the help of "Internet +" should be improved,the possibility of public interest litigation is explored to help interns with work-related injuries.
