Reseach On The Legal Rights Protection Of College Students’ Graduation Internship

Under the new background that the country vigorously promotes the integration of industry and education,the internship of college students after graduation should not only meet the students’ personal expectation of practical experience learning and meet the social needs of enterprise talents,but also open up the important part of the four chains such as the industrial chain,innovation chain,talent chain,education chain.At present,the graduation internship of college students in our country can not realize its own value aims efficiently.On the one hand,lack of enterprise internship jobs and lack of management of internship work in schools lead to the small coverage and poor effect of graduate internship so that the graduation internship of college students can not achieve better results;on the other hand,the lack of law leads to the difficulty of safeguarding rights when the legitimate rights and interests of college students are violated during the graduate internship,which consumes the enthusiasm of college students,enterprises and even colleges for graduate internship.At present stage,lack of relevant laws and regulations of college students’ graduation internship,and the unclear power and responsibility of students,enterprises and schools are the main reasons.Therefore,taking the theory of collaborative governance and game theory as the basic consideration,making and perfecting relevant laws and regulations,arousing the enthusiasm of relevant subjects such as schools and enterprises,and ensuring the legitimate rights and interests of interns,which are the prerequisite for realizing the efficient operation of graduation internship system.This paper mainly includes the following five parts: the first part is the introduction,the introduction part expounds the research background,research significance and research content in this paper,and combs the relevant present situation of college students at home and abroad at the same time;the second part is the relevant content of college students graduate internship,first defines the meaning and content of the college students graduation internship and the legal rights and interests by the college students graduation internship.The present situation of the protection of intern’s legal rights and interests in the graduation internship of college students in our country is combed,and the reasons for the insufficient protection of intern’s rights and interests are summarized.The third part mainly analyzes the legal relationship between the parties in the process of graduation internship from discussing the legal relationship and legal identity identification in college graduates’ internship.This part lays a theoretical foundation for the construction of the legal rights andinterests protection system for college students’ graduation internship.The fourth part summarizes and combs the relevant legislation and existing system of college students’ internship in the United States,Germany,Japan and other countries from two aspects such as the legislative basis and system cooperation which provides reference for constructing the relevant system of our country.The construction of college students’ graduation internship rights and interests’ security system is the core part in the fifth part of this paper.Starting from the basic principle and concrete system of college students’ graduation internship rights and interests security system,this paper constructs a legal rights and interests protection mechanism which accords with the social environment in our country.At present,the legal status of interns is not clear in the relationship of graduates’ internship in our country,and the phenomenon of infringement of legal rights and interests happens frequently.Therefore,this paper will discuss,examine and make regulation in constructing the legal system.In addition,some overseas countries have formed a relatively perfect legal system in the legal protection of the rights and interests of college students internship.Compared with it,there are still many deficiencies in the internship of college students in our country,especially in the definition of the rights and responsibilities of the relevant subjects and the legal protection of the rights and interests of the students.This paper will draw more from some foreign mature legislative experience,further explore the specific ways to protect the rights and interests of students in our country,and initially construct the relevant safeguard principles and specific safeguard measures in order to provide a good social environment and legal protection for college students’ graduation practice,safeguard the legitimate rights and interests of students,improve the quality of graduation practice,realize the value goal of graduation practice,and establish a legal protection mechanism for the legitimate rights and interests of college students’ graduation internship suitable for our national conditions.
