Armed conflicts have arisen with the history of mankind's development.Since mankind was able to arm,all kinds of armed conflicts have never stopped.Environmental protection is an emerging topic that people have gradually paid attention to in today,but human society has become more and more aware that it is human beings who ultimately suffer from being unfriendly to the environment.Environmental protection during armed conflict,as an interdisciplinary subject of international criminal law and international environmental law,is an eternal topic that cannot be ignored.The goal of this article is to find out the shortcomings of the existing rules of international law for protecting the environment in armed conflicts,and to put forward corresponding suggestions.It comprehensively uses literature research,comparative analysis,and case analysis methods to accomplish this goal.The existing rules include numerous treaties and related customs.Although they have advantages such as giving special protections for the natural environment independent of human property,expanding the protection scope of the natural environment threatened by armed conflicts,and diluting the principle of military necessity and the principle of proportionality,the disadvantages like inconsistency of the scope of application,the unclear wording of some laws,and the unclear priority of related principles are very obvious.It is difficult to make it play a better role without solving these defects.In order to improve these shortcomings,we can expand the scope of application of relevant rules,clarify relevant legal language,adhere to the principle of sustainable development,establish a World Environmental Organization and promote the coordinated implementation of international environmental treaties.Only in this way can we better promote the harmonious coexistence of man and nature and the continuous development of human society.
