A Study Of The Legality Of The Use Of Autonomous Weapons

As a new type of weapons,autonomous weapons have attracted widespread attention from the international community and related experts and scholars due to their research,use,and new problems in the field of international law.This article firstly defines autonomous weapons,expounding its characteristics and distinguishing related similar concepts.Secondly,it analyzes the legality of autonomous weapons by combining existing technology and some weapons with some autonomous weapon functions that have come out.Then,the legality and feasibility of the use of autonomous weapons will be explained from both technical and legal aspects.The technical aspect is mainly to research whether it can achieve the functions that humans envisaged that autonomous weapons can achieve.The legal aspect is mainly to research whether it can abide by the rules of international humanitarian law and the law of war and how to assume responsibility.This article believes that autonomous weapons,as a kind of weapon,can abide by the rules of current international humanitarian law,but the difficulty lies in how to use and impose liability.Therefore,controlling autonomous weapons in human hands and using them conditionally is the best explanation for the development and use of autonomous weapons.Although autonomous weapons can be used under certain circumstances,their use must be strictly restricted and supervised,and the initiative and control of their use must be in the hands of humans who can press the pause button when necessary.In addition,the international community needs to fully master various related technologies to formulate laws.When concluding relevant treaties,the international community must determine the standards for the use of autonomous weapon systems and the precise principles of liability.For examples,the weapon can be used in what kind of combat environment and what kind of technology and judgment.In addition,other technologies need to be applied to autonomous weapons,such as monitoring the whole process,determining the subsequent imputation.Finally,in terms of responsibility,it is necessary to clearly distinguish the relevant responsibilities of the responsible persons including the state,designers,commanders,actors and so on.And more precise,mandatory,and effective measures need to be formulated.
