This article research new challenges of using and developing Artificial Intelligence weapons to International Humanitarian Law and the solutions to the emergence of new weapons.Artificial Intelligence weapons have become the trend nowadays and its development is irresistible.As new type weapons,its existence or application on the battlefield are incompatible or conflicted with existing principles and regulations,especially when its concerns with International Humanitarian Law.Therefore,the author attempts to summarize the current problems and clarify the key points of the disputes,analyzing the causes of problems,and put forward opinions and suggestions based on comprehensive analysis.The article start from the international hottest topic about the classification and definition of Artificial Intelligence Weapon,the author decide to talk about the typical autonomy weapons in clarifying what is autonomy type or automatic,which can choose target and fire on key functions.The definition and characteristics of such weapons make them completely different from traditional weapons,for it brings problems are not entirely controlled by human.The weapon itself and its usage brings all kinds of challenges and problems to International Humanitarian Law,And the author try to alleviate or solve the problems in facing the challenges with the existing laws.The main challenge is to distinguish principle and proportion principle,which is due to the limitations of the weapons and its using method.Then comes the challenge of means and methods,comparing with traditional weapons,the new weapon may lose the prediction and judgment for its carrying the intelligent algorithms and technology.There are also different opinions about the responsibility of the AI weapon after the striking,but it is ultimately determined that no matter how intelligent the weapon is,it should not be responsible for its strike behavior and results.Some countries have already set an example of this murky-like challenge in practice,that is the review of weapons and meaningful human control of weapons,which should be spread around the world and better implemented.
