Research On Consumer Rights Protection Mechanism Under Shared Homestay

In recent years,with the rapid development of B & B industry,the protection of consumer rights and interests under the guidance of B & B platform has become increasingly prominent.Different from the traditional transaction mode of consumer protection,there are many subjects involved in the dispute of consumer rights and interests protection of shared B & B: B & B platform,B & B provider(or B & B landlord)and consumers.Under the sharing economy,this new transaction mode makes the existing laws and regulations have deficiencies in protecting the rights and interests of consumers.Onore thinks that the ownership is composed of 11 main standard components and that the ownership contains at least one important standard component independent of the owner's choice.With the rapid development of B & B,the property right of the house is no longer limited to the owner.Therefore,it is not limited to the traditional theory of property law.From the perspective of "right bundle",this paper analyzes the "right bundle" existing in the property of B & B,and combines with the current development mode of B & B in China,analyzes the three no's of B & B platform,B & B provider(or B & B landlord)and consumer Different rights enjoyed by the same subject and the legal relationship between them.At present,there are many problems in the field of shared B & B industry in China,including unclear legal status of B & B platform,inconsistency of rights and responsibilities of B & B providers,unclear distribution of rights and responsibilities between B & B platform and B & B providers,and inadequate supervision of B & B industry,which makes it more difficult for consumers to protect their rights.Through the use of the "right bundle" theory,this paper analyzes the rights and obligations of B & B platform,B & B provider(or B & B landlord)and consumers,combined with the problems of infringement of consumer rights and interests in the process of B & B operation in China.Based on the principle of comprehensive protection,the legal status of B & B platform and the distribution of responsibilities between B & B platform and B & B providers should be clarified at the legislative level,so as to provide consumers with clear responsibility subjects for safeguarding their rights;at the level of safeguarding rights,the dual protection of society and law should be strengthened,the role of trade associations should be brought into full play,and the mechanism of social integrity should be established and improved And information sharing platform,at the same time improve the consumer dispute litigation jurisdiction system.It is necessary to guide and standardize the legal supervision,industry self-regulation and consumer self-management to solve the disputes of consumer rights and interests protection under the condition of shared B& B.
