An Empirical Study On Community Correction Work In Qiandongnan Prefecture, Guizhou Province

Qiandongnan Autonomous Prefecture in Guizhou Province is one of the most important gathering places of The Miao and Dong ethnic groups in China.The unique cultural environment,geographical conditions and religious beliefs give birth to the unique ethnic customary law culture.From the perspective of Miao and Dong villages in Qiandongnan Prefecture of Guizhou Province,The Miaodong villages in the region still have ethnic customary law cultures that conflict with current state laws,The author USES the method of field investigation to eat and live together with miao Dong villagers,this paper analyzes and expounds the influence of miao And Dong village customary law culture on community correction,;and how can the community correction work in ethnic villages be better implemented under the influence of this customary law culture.This paper is mainly divided into five parts,four chapters,the first part is the introduction,the purpose,significance,current situation and innovation of this paper are discussed.The second part is about community correction system.First of all,from the concept of community correction,to understand the basic connotation of community correction,the basic characteristics of community correction are analyzed from the aspects of its content,nature and means.Secondly,it is the basic theory of community correction,including the theory of socialization of execution,the theory of crime labeling,the theory of deepening recovery and the theory of punishment modesty.Finally,the value analysis of community correction is carried out mainly from the aspects of humanitarian value,freedom value and fair and just value.The third part is the analysis of the customary culture and community correction in Qiandongnan Miao Dong village.Since ancient times,the villagers of The Miao-Dong ethnic group have established the rules and regulations of lang and the rules and regulations of the covenant through the legislation of the discussion of lang and the covenant of payment,as well as the village rules and regulations that have been inherited and developed to the present day.A series of indigenous customary law cultures arose.These customary law cultures have distinct ethnic characteristics,including the thought of heavy punishment for theft,the tradition of loathing and self-relief,the unique marriage custom,the unique civil society organization and the open collective punishment.The author discusses and analyzes the conflict and integration between these customary law cultures and the relevant legal systems stipulated in the current Community Correction Law.The fourth part is the influence of customary law culture on community correction in Qiandongnan Miao Dong village.Mainly from the positive and negative aspects of the discussion,the first is the positive impact,the harmonious,inclusive and mutual assistance inherent in the village ethnic customs is conducive to the positive promotion of community correction work,the mediation system of Zhaoluo and Lioluo is beneficial to the restorative justice of community correction.Secondly,it has a negative impact on the implementation of community correction because of the great difference between the village common law and the national law between crime and non-crime,felony and misdemeanor.At the same time,the lack of professional correction knowledge will also affect the community correction work due to the low educational level of The Village and the Village.The fifth part is also the last chapter of the thesis,based on the analysis and discussion of the previous chapters and the field investigation of Miao Dong village,the author puts forward specific countermeasures to improve the community correction work of minority villages in southeast Guizhou.
