Research On Privacy Protection In Driverless Cars

This paper focuses on the privacy protection issues of autonomous vehicles,the particularity and importance of privacy protection from autonomous vehicles to demonstrate the necessity of privacy protection issues of autonomous vehicles: particularity lies in the citizens' right of privacy protection issues in the autonomous vehicles with traditional privacy,the context of other special privacy protection problems exist significant differences;The importance lies in that the protection of privacy in autonomous vehicles is the protection of citizens' rights,the maintenance of commercial value and the maintenance of social order.The main part of this paper systematically studies the privacy protection of citizens in autonomous vehicles from three parts: tort subject,tort act and tort liability.The subject of infringement is classified into the government,commercial companies and individuals,which is conducive to more accurately capture and determine the location of the right tortfeasor.In tort acts,the profit driven capital and the lack of supervision create a vacuum for the protection of rights,which jointly contribute to the motivation of tort.Motivation promotes torts,there are many types of tort behaviors,such as reading tortfeasor features,associating personal information,drawing location maps,deducing the purpose of behaviors,revealing personal preferences,etc.Tort has the characteristics of space leaping and subject extensiveness,technical specialization and behavior concealment,difficulty in identification and multiple probability.In addition,it makes a detailed analysis of tort liability,and analyzes the principles of liability for tort liability: the principle of fault liability for general privacy tort liability,the principle of no-fault liability for strictly cracking down on tort acts and the principle of comprehensive liability for different tort subjects,and supports the latter.In conclusion,the modes of tort liability are property type,spirit type and prevention type,and the latter is supported.Finally,from the perspective of prevention,the paper also puts forward other protection measures for the government,operators and users of autonomous vehicles:the government should implement resident supervision and tracking supervision;Operators should formulate reasonable privacy protection agreements and security agreements,ensure the limitation of generated and provided data,desensitization,restraint in retention and daily maintenance,and maintain the security integrity and necessary location of data;From the perspective of the right to know,the right to choose,the right to be forgotten and the right to guarantee information,the users of autonomous vehicles propose that in order to guarantee their rights,the users should also fulfill the corresponding obligation of cooperation.Thus,the role and responsibility of all stakeholders in the field of autonomous vehicles should be clarified.
