See The Function And Perfection Of Local Legislation From The Perspective Of Urban Waste Classification

Local legislation is an institutional component of the country's rule of law.Especially in a big country like China,it is unthinkable that the socialist rule of law lacks local legislation.In practice,some localities and individuals lack the understanding of the local legislative functions in China,and neglect the methods of promoting local development through local legislation.Although local legislation has been carried out in China for more than 30 years,it has developed rapidly.But generally speaking,local legislation is still in its infancy in China,and there are many problems in practice.First of all,this paper explains the concept of local legislation,expounds the development process of local legislation,and explores the legal basis and function of local legislation.Its legal basis includes that the current legislative system recognizes the legitimacy of local legislation,and the practice of local legislation shows that the value of local legislation and China's national conditions determine the existence of local legislation;Its functions include making up for the deficiencies of the central legislation,providing a place for legislative experiments and institutional innovation,optimizing and improving the local governance structure,and highlighting the democratic value of modern legislation.Secondly,from the perspective of local legislation of municipal waste classification,this paper analyzes and compares the legislative status quo and practice of municipal waste classification system in different regions,and analyzes the realization of its preset functions as an important part of local legislation.The function of local legislation needs to be further improved.Thirdly,this paper further analyzes the reasons of hindering the function of local legislation.It mainly includes that the legislative body does not pay enough attention to the function of local legislation and the ability of the legislative body,the division of powers and functions between the central and local governments is not clear,the local legislation is not adapted to local conditions,lacks of local characteristics,the lack of legislative technology and legislative methods in local legislative work,and the lack of space for citizens to participate in local legislation.Finally,in view of the above-mentioned problems,the paper puts forward corresponding suggestions for improvement,including:Innovating the cognition of the legislative body on the legislative function and improving the corresponding ability,clarifying the legislative authority,avoiding legislative conflicts,adapting measures to local conditions,highlighting local characteristics,improving local legislative technology and methods,and improving the relevant mechanism of citizens' participation in local legislation.
