The Legal Thinking Of Consolidating The Consciousness Of The Community Of The Chinese Nation

In the epidemic and post epidemic era,the Chinese nation is facing many challenges,such as realizing ethnic unity and national unity,promoting the modernization of national governance capacity and governance system,and building a socialist society ruled by law with Chinese characteristics.The community of shared future of the rule of law for Chinese nation is a relational paradigm of Chairman Xi's rule of law thought,the strategy of governing the country by law,the construction of "five identities",the construction of the community of shared future for Chinese nation,and the establishment of the consciousness of Chinese nation community,which is aimed at safeguarding the fundamental rights and interests of the people by the well-being of the rule of law and the link of shared future.Based on the methodology of comprehensive jurisprudence,this paper analyzes the juristic meaning and the consolidation of the the consciousness of Chinese nation community from the perspective of the community of shared future of the rule of law.In addition to the introduction and conclusion,it is divided into three chapters.The first chapter is the logic connection of this proposition.On the one hand,it analyzes the juristic meaning of the community of shared future of the rule of law for Chinese nation and its logical connection with the consciousness of Chinese nation community.The community of shared future of the rule of law is the basis and practical logic of the consolidation of the consciousness of Chinese nation community,and the consolidation of the consciousness of Chinese nation community is the core and purposive logic of the community of shared future of the rule of law.On the other hand,it analyzes the realistic juristic dilemma of legitimacy and rationality in the process of consolidating the consciousness of Chinese nation community which mainly includes that the corresponding extremism and identity crisis distorts its juristic meaning,the structural conflict risk of "pluralism" and "integration" shakes its juristic system under the background of globalization,and the imbalance between national and regional development hinders its juristic practice.The second chapter is the juristic logic of the consciousness of Chinese nation community in the community of shared future of the rule of law.First of all,the consciousness of Chinese national community has multi-dimensional juristic bases:the CPC is the core leading basis of its juristic construction,the constitution is the fundamental basis of its juristic authority,and the system of regional ethnic autonomy is the basic institutional basis of its juristic practice.Secondly,the consciousness of the Chinese nation community includes the connotation of the multi legal relationship in the integration of different nationalities,the juristic rights and obligations of the citizens of different nationalities in the community of shared future of the rule of law,and the modern rules and principles in the process of the rule of law on the governance of ethnic affairs.Thirdly,within the scope of the rule of law of socialism with Chinese characteristics,the consciousness of Chinese nation community presents a social unity of virtue and rationality of law,which conforming to the moral and social norms of law,standardizing and guiding the integration of national inter ethnic politics and the construction of modern national society.Finally,the consciousness of Chinese nation community contains,expands and neutralizes the values of justice,equality,order,freedom,etc.In addition,it makes the above values blend in the community of shared future of the rule of law.The third chapter is to uphold the concept of comprehensive rule of law to consolidate the consciousness of Chinese nation community.First of all,the socialist rule of law with Chinese characteristics should be used as the guarantee to consolidate the consciousness of Chinese nation community,such as deepening the legalization of the consciousness of Chinese national community with the Constitution as the core,promoting the law-based governance of ethnic affairs with the CPC as the core,and improving the guarantee of the democratic and legal field on the construction of the Chinese nation and the unity of ethnic groups.Secondly,the consciousness of Chinese nation community should be cemented with the shared spiritual home of the rule of law as the soil.We should shape the consciousness of Chinese nation community which as the symbol of modern culture of the rule of law for the Chinese nation,and we should enhance the juristic education of the citizens' political identity and the consciousness of Chinese nation community.Finally,based on the construction of the rule of law in the system of regional ethnic autonomy,strengthening the consciousness of Chinese nation community is of vital importance.We should promote the modernization of the regional ethnic autonomy law and supporting legislation,extending the legal relationship between the consciousness of the Chinese nation community and the autonomy of ethnic autonomous areas,and implementing the standardized supervision of the autonomy of ethnic autonomous organs in accordance with the law.Under the background of interweaving globalization and anti globalization,the community of shared future of the rule of law for Chinese nation is not only a dynamic reflection of the domestic and international pattern of great changes,but also a field of community with the function of guarantee to the Chinese nation which based on the modernization of the rule of law.What's more,it is an advanced form of national community paradigm provided by the Chinese nation for the the international pattern of the rule of law and the historical shared future of mankind.As a sacred norm of universal kindness and conscience,the consciousness of Chinese nation community carries and integrates the historical mission,collective will,identification mechanism and social power in the community of shared future of the rule of law,achieving the sublimation of socialist rule of law with Chinese characteristics,and reflecting the transcendental concern of grand shared future of mankind.
