Research On Short Video Copyright Infringement

With the rapid expansion and deep development of short video industry,the problem of short video copyright infringement has become a pain point of the industry.How to effectively curb short video copyright infringement and regulate the development order of short video industry has become a common concern of both theoretical and practical circles.This paper analyzes the short video copyright recognition,the content of short video copyright owners' rights,the composition of short video copyright infringement,the fair use rules and safe harbor rules in the short video copyright infringement recognition,and sorts out the current situation of short video copyright infringement in China.Furthermore,it is suggested to improve the prevention mechanism of short video copyright infringement by promoting the real-name authentication of short video users,implementing the legal responsibility of short video platforms,enhancing the copyright protection awareness of short video users,and strengthening the technical means of short video copyright protection.By improving the implied license of short video for the use of related works,introducing creative Commons license agreement,giving play to the media role of copyright collective management organization and short video platform,effectively reducing the infringement problem caused by the use of short video related works;Through perfect and unified short video copyright infringement damage compensation legal standard of judicial judgment,give play to the role of discretionary compensation balance of interests,strengthen the punitive damages in a short video copyright infringement compensation in judicial application,short video works perfect tort damages system,break the holder of the rights rights predicament of "pay";In order to solve the problem of short video copyright infringement in China,this paper discusses the ways to regulate short video copyright infringement.
