Flexible employment is a crucial employment form in China.As the mainstay of China's labor market,flexible employment personnel significantly contribute to economic growth and social progress.However,due to the failure of China's current social insurance system to adapt to the trend of flexible employment,Flexible employment personnel are facing the problem that the rights and interests of social insurance can not be guaranteed.This paper mainly studies the legal problems existing in the current social insurance system,And put forward targeted suggestions to protect the social insurance rights and interests of flexible employees.Based on the definition of the concept of flexible employment and academic theory,this paper analyzes the existing legal problems and reasons from the perspective of legislation and judicature.On the basis of studying the social insurance system of some foreign countries,this paper obtains the Enlightenment of protecting the social insurance rights and interests of flexible employees.Finally,from the perspective of principles and specific measures,this paper gives some suggestions to improve the social insurance system of flexible employees in China,which provides theoretical support for protecting the social insurance rights and interests of flexible employees.
