Research On Legal Issues Of International Nuclear Pollution Control

With the development of economy and technology,the impact of nuclear pollution is more and more serious.In recent years,the impact of many nuclear accidents has expanded to neighboring countries,and the international nuclear pollution problem is becoming more and more serious.Therefore,it is very important to study the legal issues of international nuclear pollution control.This paper is divided into the following three parts to study the legal issues of international nuclear pollution control:The first part of this paper introduces the nuclear pollution.About nuclear pollution,China has formulated a series of laws and regulations,and several conventions have been adopted among countries.However,domestic law and international law rarely involve international nuclear pollution control.The second part of this paper analyzes the deficiencies of the international legal system of nuclear pollution control.The international environmental impact assessment system of nuclear pollution prevention and control is facing the following difficulties: First,the international conventions related to the international environmental impact assessment system of nuclear pollution prevention and control are flawed;Second,the international community lacks regulatory agencies;Third,it is difficult to achieve international cooperation;Last,high level technology is required.Besides,there are problems in both procedure and entity in the legal way of international nuclear pollution dispute settlement.Investigation of state responsibility for nuclear pollution has some deficiencies in international conventions,causality proof,environmental damage standards,individual prosecution and so on.The main content of the third part of this paper is how to improve the international legal system of nuclear pollution control.In order to improve the international environmental impact assessment system for nuclear pollution prevention and control,each country needs to improve legislation,supervision and information exchange.In addition,in improving the international nuclear pollution dispute settlement mechanism,each country can improve the international treaty to establish an international nuclear pollution dispute settlement body and strengthen international cooperation.At the same time,in order to make up for the lack of national accountability for nuclear pollution mentioned above,countries all over the world need to take corresponding measures to improve it.
