Research On Legal Issues Of Online Transaction Fraud

With the continuous advancement of China's information construction,the network has been gradually popularized in people's life,and many traditional forms of industries are gradually networked.Network transaction is the most typical representative.Network transaction subverts the traditional trading mode.It virtually changes people's consumption habits and working methods,and makes people experience an unprecedented trading mode.Although the efficiency and convenience of network transactions provide people with a lot of convenience,there are also some risks in online transactions,and online transaction fraud bears the brunt.With the surge in the number of users of network transactions,the trading platform is becoming more and more perfect,and the network transaction fraud is also "evolving",its behavior is becoming more and more complex and diversified,and the harm is becoming greater and wider,which has also attracted people's extensive attention.While enjoying the convenience brought by network transactions,there is also a strong voice on regulating network transaction fraud.In order to ensure that the legitimate rights and interests of both parties are not damaged,maintain a stable network transaction order and build a fair network transaction competition environment.This paper concludes the basic discussion and common forms of network transaction fraud through the investigation and analysis of various fraud behaviors in network transaction.Moreover,by consulting relevant materials,this paper combs and summarizes the legislation of network transaction fraud in civil law,and discusses and analyzes the identification elements of online transaction fraud.Through the combination of theory and practice,this paper summarizes the legal problems existing in network transaction fraud in China.At the same time,in order to better solve these problems,this paper analyzes and draws lessons from the laws of some countries with good development of e-commerce industry.On the premise of fully considering China's actual national conditions and laws and regulations,this paper puts forward to improve the legislation,divide responsibilities and build a credit system,improve the regulation of online transaction fraud,and improve the responsibility consciousness of online transaction platform,Enhance the safety awareness and integrity concept of both sides of network transactions,reduce network transaction fraud,and promote the healthy development of China's network trading market.
