Case Study On Telecom Network Fraud

With the rapid development of science and technology information and communication technology,Internet is widely used in all walks of life.Therefore,the use of scientific and technological information and communication network for new crimes has become fierce and intensified,which has become a prominent problem that endangers the safety of people's property.These criminal acts not only endanger people's property safety,but also affect social stability.Through ten cases of telecom network fraud,this paper summarizes the characteristics of telecom network fraud.Compared with the traditional crime of fraud,telecom network fraud crime presented the more harmful to society and the victim,crime across provinces,multinational and international highlight,are less likely to be found,increases the virtual link,crime concealment,low cost,to evade detection means smart,crime,and wide geographical and changeful crime syndicates field,etc.The difficulty of telecom network fraud crime lies in the difficulty of investigation,difficulty to investigate and collect evidence,arrest and fundamentally dealing with it.Therefore,in order to effectively curb the occurrence of telecom network crime,the government should put forward corresponding countermeasures and Suggestions from the legislative,law enforcement and judicial aspects.The conditions for the occurrence of online fraud crimes are all-sided.From the perspective of legislation,the related legislative issues of online trading platform,online fraud equipment and telecom operators can be concluded as the criminal network fraud.From the perspective of law enforcement,there are deviations in the identification of telecom network fraud,and the identification of fraud equipment cannot be timely identified and the supervision system is backward.From the perspective of judicature,there are problems in the identification of human evidence and material evidence.In order to effectively combat telecom network fraud,the related legislation of network transaction platform should be perfected.In terms of law enforcement,improve the scientific and technological content and detection level of equipment to detect network telecom fraud crimes,and ensure the control of public security organs on virtual network;In the judicial aspect,attention should be paid to the effective extraction and use of online evidence.
