Investigation And Case Study Of Injury Accidents In Sports Teaching Of Middle School Students In Xinjiang

On March 5,2021,the Fourth Session of the 13th National People's Congress(NPC)opened.The National Committee of the Chinese People's Political Consultative Conference(CPPCC)proposed to enhance the diversity of physical education classes and vigorously carry out physical activities of various projects,so that sports will become a lifelong sport and more students will participate in physical activities.In school sports activities,middle school students have been under school management,parents' protection,teachers' supervision for a long time,and lack of self-prevention awareness and safety state,which leads to a high frequency of injury accidents in physical education teaching.Injury accidents in school physical education teaching have become a topic that scholars are eager to discuss in recent years.Wuhan University immediately established the major of sports law.It is imperative to refine sports legal system.With the birth of the Civil Code in 2021,the Tort Liability Law of China was abolished immediately,and the relevant articles on sports injury accidents were added.This paper aims to study 20 legal documents of injury accidents in physical education teaching of middle school students in Xinjiang,and analyze the factors affecting injury accidents in combination with relevant legal provisions and literature.According to the characteristics of injury accidents in physical education teaching,500 high school students in Urumqi,Xinjiang are randomly selected.From the perspective of the safety state of teachers and students in physical education teaching,the following conclusions are drawn by the combination of trial practice and questionnaire survey:5.2.1 Formulate and improve laws on sports injury accidents,and sports disputes,as a special nature of disputes,cannot be divided into general infringement disputes.In the aspect of liability determination,fault liability and no-fault liability are separated.The subject of no-fault liability does not need to make compensation to the victim.Accidents that occur when students voluntarily participate in sports activities are at their own risk.In the aspect of proof,it advocates the application of fault presumption,and does not advocate the use of the principle of fair liability.5.2.2 Establish a special compensation fund.Due to the second-instance final system of school physical education in our country,the huge amount of compensation makes the school physical education greatly shrink;The establishment of a special fund is not to shelter the perpetrator and protect oneself from liability;Instead,they hope to make up for the loss of the victim after the dispute occurs.For example,if the victim is seriously injured in sports teaching,high medical expenses are needed.If the victim does not get compensation from others,the fund will pay in advance,and the victim will seek compensation from the injurer later.5.2.3 Strengthen physical education teachers safety education training and how to deal with safety accidents,cultivate safety awareness of middle school students,effectively improve safety prevention skills of middle school students and participate in sports rehabilitation therapy through training and drills are effective measures to prevent sports safety injury accidents of middle school students.5.2.4 It is the organizational requirement to prevent middle school students' sports safety education and management to strengthen the physical education teaching management,strictly regulate the scientific and normative nature of physical education teachers' classes,strengthen the training of physical education teachers' safety knowledge and first-aid skills,and improve their treatment ability.5.2.5 Strengthen the publicity of sports safety education for middle school students through multiple channels and improve the understanding of colleges,society and families on students' sports safety accidents,which is the basic requirement of reasonable handling of students' sports safety education and management.5.2.6 Increase the team of physical education teachers,improve the overall quality of physical education teachers,improve the training and assessment of the selection of physical education teachers,and make the best of the best.
