Research On Criminal Liability For Marine Oil Spill Pollution

Due to the serious damage caused by the marine oil spill pollution accident,it has been impossible to restrain it by civil and administrative means in practice.Under the background that the society is gradually attaching importance to marine environmental protection and sustainable development,the criminal responsibility of marine oil spill pollution is an important aspect of people’s review of marine oil pollution.Marine oil spill directly threatens the balance of the marine ecosystem,and criminal sanctions against it are very important.Is necessary.Taking the marine oil spill pollution as the starting point,this thesis analyzes the current judicial practice of marine oil spill pollution in my country,and in-depth demonstrates the necessity of pursuing criminal responsibility for marine oil spill pollution.Based on the legal basis,the criminal legislation of marine oil spill pollution in my country is evaluated and analyzed,and the difficulties in the application of the crime of environmental pollution,the connection between criminal law and administrative law,and the single type of punishment are discussed,and some suggestions for the improvement of criminal responsibility are put forward.This article is divided into five chapters:The first chapter starts from the status quo of criminal responsibility for marine oil spill pollution,and analyzes that my country mainly pursues civil liability and administrative liability for marine oil spill pollution,and has never investigated criminal responsibility for the crime of polluting the environment.The second chapter analyzes the necessity of investigating the criminal responsibility for the marine oil spill pollution.In view of the controversial viewpoints,it is believed that the criminal responsibility for the marine oil spill pollution should be investigated.The third chapter analyzes the factual basis and legal basis for investigating the criminal responsibility of marine oil spill pollution,which provides theoretical support for the investigation of criminal responsibility for marine oil spill pollution.The fourth chapter evaluates and analyzes the legislation of criminal liability for marine oil spill pollution,analyzes the application of my country’s environmental pollution crime in marine oil spill pollution,the difficulty in connecting criminal law and administrative law,and the single type of punishment,and sorts out the legislation outside the territory and the problem.Inspiration from it.The fifth chapter is mainly based on the above-mentioned suggestions on criminal responsibility for marine oil spill pollution,and puts forward its own opinions on the introduction of judicial interpretations,strengthening the connection between administrative law and criminal law,and improving the structure of punishment.
