| With the continuous development of plastic industry,plastic products make our life greatly convenient.At the same time,due to unreasonable disposal,a large number of plastic waste into the sea,greatly polluted the Marine ecological environment.The international community has taken active actions to solve this problem,but from the current situation of pollution,pollution is still serious,which is bound to the current international governance mechanism is not perfect.In this context,it is necessary to jump out of the boundaries of a single sovereign state and actively improve the international governance system of global Marine plastic waste management under the framework of international law based on the urgent situation of Marine plastic waste pollution.The introduction of this paper mainly introduces the research background and significance of Marine plastic waste pollution,and also sorts out the research status of domestic and foreign scholars on Marine plastic waste pollution control.It can be found that facing such a global environmental problem as Marine plastic waste,the construction of an international treatment system for Marine plastic pollution is a feasible way to solve the problem.The first chapter is the general theory of global ocean plastic waste management.Through the introduction of the harm of Marine plastic waste and the connotation of treatment,the necessity of global treatment of Marine plastic waste was analyzed.This chapter specifically introduces the basic principles of Marine plastic waste management,which can provide theoretical support for the priority use of international law in the process of international community’s joint treatment of Marine plastic waste pollution.Chapter two is the regulation of international law on global Marine plastic waste management.This paper sorts out the existing and ongoing international treaty laws and soft laws in the international community,interprets the legal provisions related to the management of Marine plastic waste,and provides content support for the follow-up study of the problems existing in the current international law.The third chapter analyzes the existing problems and causes of international law regulation of global Marine plastic waste management.Through the analysis of the current international law governance mechanism,and puts forward the global ocean plastic garbage management international law regulating the lack of contracting the performance mechanism,the management of unified standard,cohesive mechanism of terrestrial and Marine plastic treatment not free,the principle of common but differentiated responsibility is difficult to implement and the function of the soft law co.,LTD.On the basis of the problems,the reasons for the above problems under the current governance framework of international law are further analyzed,mainly due to the uneven level of compliance capacity of States parties,the great difference in governance capacity,the different ways of application of international treaties,the lack of governance awareness of the community with a shared future for the ocean,and the different maritime interests of various countries.Fourth chapter for countermeasure part,puts forward specific solutions,including parties performance mechanism,clear sea plastic waste management to unified standard,establish the linkage between the terrestrial and Marine plastic treatment mechanism,with the international treaty to promote the implementation of the principle of common but differentiated responsibilities and to enhance the global ocean plastic over the role of soft law.At the same time,as a member of the international community,China’s approach to improve the regulation of international law on global Marine plastic waste management is put forward.The last part of the conclusion is the review and summary of all the research content. |
