There years with the rapid growth of e-commerce in China,various economic development models emerge one after another.Internet plus has optimized and upgraded traditional industries according to its own advantages.The takeaway industry has been rising under the guidance of the "Internet plus" mode.The Internet takeout industry has undoubtedly greatly stimulated economic development,created a large number of jobs and changed our way of life.However,in this context,as the takeout industry uses a large number of disposable plastic lunch boxes,it falls into the dilemma of plastic waste treatment.In this paper,the treatment of take-out food derived waste is studied and analyzed with disposable plastic lunch boxes as the focus.Based on the theory of recycling and reduction of plastic tableware in China and abroad,this paper discusses the legal development of disposable tableware based on the theory of recycling and reduction of plastic packaging and the sustainable development of disposable tableware,In order to find a solution to the problem of negative externality of environmental cost caused by the development of takeout industry in China.This paper will be discussed in five chapters.The first chapters introduce the types of takeout derived waste,analyzes the impact on the environment and the necessity of perfecting the law.The second chapters talk over the legal theoretical basis of takeout derived waste treatment from the aspects of circular economy theory,3R theory,internalization of external costs,combined with economic analysis and producer responsibility extension system.The third part,according to the current relevant legal provisions,the current situation of waste classification management and the implementation of the new plastic limit order,analyzes the current situation and existing legal problems of the treatment of takeout derived waste in China.The fourth part introduces the relevant legal norms for the management of plastic packaging products,the practical experience of the extended producer responsibility system(EPR)and the relevant legal system of waste classification in America,Japan and Germany,and improves the system construction of China’s environmental governance capacity by learning from the experience of foreign countries in the treatment of disposable plastic lunch boxes.The fifth part summarizes the introduction and discussion of the first four parts,and puts forward some suggestions to improve the legal system of takeout derived waste in China.On the practical road of ecological and environmental protection,we should take a long-term view.We must regard the economic system as a subsystem of the ecosystem and guide the harmonious development of economic growth and ecological civilization.Therefore,the author hopes to Make a modest contribution to exploring the sustainable development path of the takeout industry.
