China now is comprehensively developing the construction of ecological civilization.It’s necessary to continuously learn from the relatively developed environmental legal systems of other countries based on China’s specific national conditions and practical needs to further improve related legal systems.This includes the system of public participation in environmental impact assessment.The environmental impact assessment system adheres to the "prevention-oriented" approach.As an important environmental management tool,it has gradually been established as a basic environmental law field by countries around the world due to its scientific foresight,professional technology,and comprehensive content.Public participation,as a democratic and scientific method in the environmental impact assessment system,has been vigorously promoted by countries around the world.The United States is the first country in the world to establish a system of public participation in environmental impact assessment.It has comprehensively analyzed the time,stage,method and guarantee of public participation,and has formed a comprehensive legal system document for the public.However,the process of public participation in the protection of environmental lakes in our country is a short board,compared with the United States,it still lags behind.Therefore,this article focuses on the law system of public participation in environmental impact assessment in the United States.By introducing its background and legal origin,it further analyzes the characteristic legal protection system.It is hoped that the system in China will be further improved.In addition to the introduction and conclusion,the main content of this thesis is as follows:The first part mainly explains the basic characteristics,main functions and theoretical basis of the public participation system in environmental impact assessment,and provides the theories foundation for the in-depth exploration of this system.The second part introduces the background and legal origin of the US environmental impact assessment participation system,and has a general understanding of the US system.From the three aspects of rights protection,judicial protection and financial protection,it can be seen that the system in the United States has truly and fully protected public participation and made its effectiveness of public participation in impact assessment evident in the world.The third part introduces the legislative process and practice of China’s public participation system for environmental impact assessment.Based on that,analysing the defects in the existing system,and putting forward suggestions on some specific measures,mainly in the stage of clarifying the subject,the stage of early participation,and improving the disclosure of information System,perfect relief channels,And drawing lessons from the shortcomings of the US system.
